01acceptance

By downloading, accessing, or using Foldicon, you agree to these Terms of Use. If you do not agree, do not use the app. Apple's Standard End User License Agreement also applies to your download from the Mac App Store; where it conflicts with these Terms, these Terms govern the app itself.

02what foldicon is

Foldicon is a macOS utility that applies custom icons to folders you choose. Browsing the icon library and applying icons happen entirely on your Mac. Foldicon also includes an AI icon generator: when you use it, the photo you supply is sent to our server and on to our AI provider to be drawn, then returned to your Mac. Nothing else leaves your machine. See our Privacy Policy for exactly what is sent and stored.

03license

Foldicon is free to download. We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Foldicon on devices you own or control. You may not sell, rent, sublicense, reverse engineer, or redistribute the app except as permitted by applicable law. Some features are paid — see credits and purchases below.

04the icon library

Foldicon ships with a library of original icon artwork. That artwork remains ours. Within the app's license, you may:

• Apply any bundled icon to folders on devices you own or control.
• Keep those icons in place in screenshots, videos, streams, or other material you publish, including commercially.

You may not extract, export, repackage, resell, or redistribute the artwork as icons, icon packs, stickers, NFTs, print products, or training data, whether modified or not, and whether or not you charge for it.

05your folders and your images

Images you supply and folders you modify are yours. We claim no ownership over them.

When you use the AI generator, you grant us and our AI provider a limited licence to transmit and process that photo for the sole purpose of producing your icon. That licence ends when the icon is returned. We do not store your photos, and we do not use them to train any model.

You are responsible for having the rights to any image you use, and for the folders you point Foldicon at. Applying a custom icon writes a small icon file into the folder; removing the icon removes it again. Keep backups of anything you cannot afford to lose.

06ai generation

Foldicon can turn a photo you supply into a folder icon using a third-party AI image model. By using it you agree to the following.

Rights and consent. You must own or have permission to use every photo you upload. If other people appear in it, that means their permission. Do not upload photos of people who have not agreed, photos of children who are not yours, or images you found online and do not have the rights to.

What you may not generate. Do not use the generator to create sexual content, content depicting minors inappropriately, hateful or harassing imagery, content designed to impersonate or defame a real person, or anything unlawful. Our AI provider applies its own safety filters and may refuse a request.

The output. Icons you generate are yours to use on your own devices, on the same terms as the bundled library in section 04. Output is produced by a machine learning model: it is stylised, it is not a photograph, it will not be an exact likeness, and identical inputs may produce different results. We make no promise about accuracy, quality, or resemblance. Similar output may be generated for other users, and we cannot grant you exclusivity over it.

It is AI-generated. Icons made this way are artificially generated content and, where required, are marked as such in the file's metadata. If you choose to publish an icon somewhere, disclosing that it was AI-generated is your responsibility.

Availability. The generator depends on a third-party service. It may be slow, unavailable, changed, or discontinued. Your use of it is also subject to the terms of our AI provider.

07credits and purchases

Generating an icon consumes credits, which you buy as a consumable in-app purchase through the Mac App Store.

• Apple takes the payment. All billing, taxes, and refunds are handled by Apple under their terms. We never see your payment details.
• Credits are consumable. They are spent when a generation succeeds, have no cash value, cannot be transferred or exchanged for money, and are not a stored-balance or payment instrument.
• Failed generations don't cost you. If a generation fails or is refused, the credit is not consumed.
• Credits are tied to your device. There are no accounts, so credits live with the installation. Deleting the app, wiping the device, or asking us to erase your data will forfeit any unused credits.
• Refunds are requested from Apple, not from us. Where local consumer law gives you a right of withdrawal, that right is unaffected by anything in this section.
• Pricing may change, and we may change how many credits a generation costs, with the price shown before you buy. We will not retroactively charge for anything you already have.

08your responsibilities

• Use Foldicon in compliance with applicable law and the policies of your operating system and app marketplace.
• Do not use Foldicon in any way that disrupts, damages, or interferes with other software or hardware.
• Do not use Foldicon to apply artwork you do not have the rights to.
• Only upload photos you have the right to use, with the consent of anyone in them.
• Do not attempt to bypass credit metering, forge purchases, script or automate the generator, or otherwise abuse the service.
• Do not use generated output to mislead people about a real person's words, actions, or endorsement.

09disclaimers

Foldicon is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability, or uninterrupted operation.

This applies with particular force to AI-generated output, which is produced by a third-party model we do not control. We do not warrant that output will be accurate, appropriate, resemble anyone, be free of resemblance to third-party material, or be suitable for any purpose.

10limitation of liability

To the maximum extent permitted by law, Luminoxe and its owners, officers, employees, and affiliates are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, revenue, goodwill, or business arising out of or related to your use of, or inability to use, Foldicon.

To the maximum extent permitted by law, total liability for any claim related to Foldicon will not exceed the greater of the amount you paid us for Foldicon and its in-app purchases in the twelve (12) months before the event giving rise to the claim, or USD $10.

11indemnification

You agree to defend, indemnify, and hold harmless Luminoxe and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of Foldicon or your violation of these Terms or applicable law — including any claim brought by a person whose photo you uploaded without permission.

12suspension or termination

We may suspend or discontinue Foldicon, its features, updates, or related services at any time if required by law, platform policy, abuse prevention, or security reasons.

We may refuse or block generation requests, and stop serving a device, where we reasonably believe the service is being abused or used in breach of section 06 or 08. Where we end your access for abuse, unused credits are forfeited. Where we discontinue the generator for our own reasons, we will honour outstanding credits or refund them where practicable.

13changes to these terms

We may update these Terms from time to time. Continued use of Foldicon after changes become effective means you accept the revised Terms.

14who may use foldicon

You must be at least 13 years old to use Foldicon. If you are under 16 and in the European Economic Area or the United Kingdom, you may only use the AI generator with the consent of a parent or guardian, who accepts these Terms on your behalf. You must also be legally able to enter a binding contract and not barred from doing so under applicable law.

15the app store

Foldicon is distributed through Apple's Mac App Store. The following apply to that distribution, and Apple requires that we say them plainly.

• This agreement is between you and Luminoxe only, not with Apple. Apple is not responsible for Foldicon or its content.
• Your licence to use Foldicon is limited to Apple-branded products you own or control, as permitted by the App Store Terms of Service Usage Rules.
• Support is ours, not Apple's. Apple has no obligation to provide maintenance or support for Foldicon.
• Warranty. To the extent any warranty is not effectively disclaimed, we are solely responsible for it. If Foldicon fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app. Apple has no other warranty obligation to you, and any other claims arising from a failure to conform are ours alone.
• Claims. We, not Apple, are responsible for addressing any claim about Foldicon — product liability, legal or regulatory non-compliance, consumer protection, privacy, or similar.
• Intellectual property. If a third party claims Foldicon infringes their intellectual property, we, not Apple, are solely responsible for investigating, defending, settling, and discharging that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using Foldicon.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, on your acceptance, have the right to enforce them against you.
• Questions, complaints, or claims should go to Luminoxe LLC at foldicon@luminoxe.com.

16governing law and disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

You and Luminoxe agree to the exclusive jurisdiction of the state and federal courts located in the State of Texas for any dispute arising out of or relating to these Terms or to Foldicon, and each of us waives any objection to venue there.

Before filing anything, email us at foldicon@luminoxe.com and give us 30 days to resolve it. Most things get sorted this way.

If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction whose law grants you mandatory protections, nothing here deprives you of those protections or of the right to bring proceedings in your local courts.

17export and sanctions

Foldicon and the AI service behind it are subject to U.S. export control and sanctions laws. You may not use Foldicon, or export or re-export it, in violation of those laws — including into any embargoed country or to any person on a restricted-party list. You confirm you are not such a person and are not acting on behalf of one.

18ending it

You can stop using Foldicon at any time by deleting the app; that ends these Terms for you, other than the sections that by their nature survive (ownership, disclaimers, liability, indemnification, and governing law). Unused credits are forfeited on deletion, as set out in section 07.

19the boring but necessary bits

• Severability. If any provision is held unenforceable, it is limited or removed to the minimum extent necessary and the rest stays in force.
• No waiver. If we don't enforce something straight away, we haven't given up the right to enforce it later.
• Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about Foldicon, and replace anything said before.
• Assignment. You may not assign or transfer these Terms. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
• Force majeure. Neither of us is liable for delays or failures caused by events outside reasonable control, including outages at our hosting or AI providers.
• Notices. Legal notices to us go to foldicon@luminoxe.com. Notices to you may be given in the app, in release notes, or on this site.
• Language. These Terms are written in English; a translation is provided for convenience only, and the English version governs.
