Terms of Use

1Acceptance

By downloading, accessing or using Notesy, you agree to these Terms of Use. If you don't agree, don't use the app. If you got Notesy from the Mac App Store, Apple's Standard End User License Agreement also applies. Where the two conflict, these Terms apply to the extent Apple allows.

2What Notesy Is

Notesy is a macOS app for writing and organizing sticky notes that sit along the edge of your screen. It includes formatting, quick math, timers, clipboard collecting, optional iCloud sync and, on supported Macs, writing features powered by Apple Intelligence. 3License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Notesy on Macs you own or control, as permitted by the App Store's usage rules. You may not sell, rent, sublicense, reverse engineer or redistribute the app, except where applicable law allows.

4Your Notes

Everything you write in Notesy belongs to you. We don't claim any rights to your notes and never receive them. Your notes are stored on your Mac and, if you turn on iCloud sync, in your own iCloud account.

You're responsible for keeping backups of anything important. We aren't able to recover notes that are deleted, lost with a device, or removed from your iCloud account.

5Your Responsibilities

• Use Notesy in line with applicable laws and the policies of macOS and the Mac App Store.
• Don't use Notesy in a way that disrupts, damages or interferes with other software, hardware or services.
• Only collect content with /paste that you have the right to copy.

6Apple Intelligence and Quick Math

Proofreading, rewriting, summaries, to-do lists, and suggested titles and icons are generated by Apple's on-device model and may be inaccurate or incomplete. Review the results before relying on them.

Quick math results and currency conversions are provided for convenience. Exchange rates come from a third-party service, may be delayed or unavailable, and aren't financial advice.

7Third-Party Services

iCloud sync, notifications, Apple Intelligence and the App Store are provided by Apple, purchase records are managed by RevenueCat, and currency rates come from Frankfurter. Their availability and behavior are outside our control, and your use of them is subject to their own terms.

8Purchases

Any purchase related to Notesy is processed by Apple through the App Store and is subject to Apple's terms, including its refund policies. Luminoxe doesn't process payments or receive your payment details.

9Disclaimers

Notesy is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability or uninterrupted operation.

10Limitation of Liability

To the maximum extent permitted by law, Luminoxe and its owners, officers, employees and affiliates aren't liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of data, notes, profits, revenue, goodwill or business, arising out of or related to your use of, or inability to use, Notesy.

To the maximum extent permitted by law, total liability for any claim related to Notesy won't exceed the greater of the amount you paid for Notesy in the twelve (12) months before the event giving rise to the claim, or USD $0.

11Indemnification

You agree to defend, indemnify and hold harmless Luminoxe and its affiliates from any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising from your use of Notesy or your violation of these Terms or applicable law.

12Changes and Termination

We may change, suspend or discontinue Notesy, its features or updates at any time, including where required by law, platform policy, abuse prevention or security. We may also update these Terms from time to time. Continuing to use Notesy after changes take effect means you accept the revised Terms.
